The Department of Health and Human Services (hhs) Outlines Regulations for the Use and Dissemination of Individual Health Care Information

HIPAA, Administrative Simplification (AS) provisions, defines rules and requirement on privacy and security practices of health care information. In Title II, the Department of Health and Human Services (HHS) outlines regulations for the use and dissemination of individual health care information.

These rules apply to covered entities, including health plans, health care clearinghouses, such as outsourced billing companies and community health information systems and health care providers that transmit health care information in a way that is regulated by HIPAA. [Code of Federal Regulations

The Privacy Rule establishes regulations for the use and disclosure of Protected Health Information (PHI). PHI is any information about health status, provision of health care, or payment for health care that can be linked to a person. This includes any part of a patient’s medical record or payment history. [Code of Federal Regulations. Title 45, Volume 1]

Security Rule deals specifically with Electronic Protected Health Information (EPHI) and requires Administrative Safeguards – policies and procedures designed to clearly show how the entity will comply with the act

Covered entities that out-source parts of their business processes to a trusted third party must ensure that their vendors also have a framework in place to comply with HIPAA requirements. Companies typically gain this assurance through clauses in the contracts stating that the vendor will meet the same data protection requirements that apply to the covered entity. Care must be taken to determine if the vendor further out-sources any data handling functions to other vendors and monitor whether appropriate contracts and controls are in place.

A contingency plan should be in place for responding to emergencies. Covered entities are responsible for backing up their data and having disaster recovery procedure. The plan should document data priority and failure analysis, testing activities, and change control procedures.

Internal audits play a key role in HIPAA compliance by reviewing operations with the goal of identifying potential security violations. Audits should be both routine and event-based.

In order to have an online backup that is HIPAA compliant you need to meet all the requirements of the Final HIPAA Security rule dated February 2003 and required after April 21, 2005.  You should ensure that a backup provider exceeds the standards set in the security rule by encrypting all data before it is sent over a secure SSL connection to the remote backup service. An effective solution is to have the Encryption Key generated by the customer and is known only to the customer and to ensure that the Key is not transmitted to the HIPAA compliant online backup server. 

A HIPAA online backup provider should encrypted the data on the server with military grade encryption and not accessible to the backup provider or employees.  Ensure that the local backup client encrypts all data prior to transmission to the remote systems. Data can only be recovered by transmitting it back to the local client that decrypts the data using the encryption key.

  2. These deficits are a historic increase in deficits that were already seen as being excessive. Last years deficit under the Bush administration was 406 B. This does not include 640 B borrowed from SS. Nor does it include the additional 750 B in emergency bank loans (these will likely be paid back). Average deficits under Bush were ~320 B not counting SS surpluses or bank loans.

    Interest on the debt THIS YEAR is between 4-6% of 11200 B (=~550 B).

  5. Note that the recent Geithner plan and the associated purchase of the toxic assets will NOT be repaid like the original emergency loans.

    These purchases of troubled assets are at best guess valued at 1.5% of what the gov purchased them for and are non-recourse (not paid back if the indeed prove to be worthless). So far 2500 B in troubled assets are to be puchased. Estimates are that this amounts to 1/3 of the final amount. This may prove low as history has shown that the banks will

    I’d like to know why it has to cost anything at all, don’t the insurance companies make a profit off of what they provide.
    I think that the monthly cost for a single payer plan should only cover what the actual costs are for group coverage, which means that it would change every year, it would then be self supporting.
    Meanwhile reform the current mandates on insurers coverage plans so people can buy what they want, not what some bureaucrat wants for them.

  10. surplus for the next 2 years available for borrowing and offsetting the deficits of about 460 B/yr.

    In two years time there will no longer be ANY SS surpluses and in fact SS will for the first time run deficits that “might” be repaid. I was unable to determine whether the CBO projections include these repayments. I do not believe they do since the Dems blocked legislation that would include SS Trust fund on deficit calculations. SS is an off budget item.

    If the government says 1 trillion, the REAL COST is at least 10 trillion. Who pays for this? Everything that the government has got its hands on is either broke (Medicare, Social Security, etc) or in peril. What makes you think you are going to SAVE money? It would be the 1′st time in history! The European and Canadian systems are RATIONED HEALTH CARE. Old people DIE waiting for tests! I know first hand….I have relatives living in Europe. And, now, we are going to be like THEM?

  13. None of these numbers include the impact of the socialization of health care. It is yet unknown what will result from this legislation. The Democrats have changed the rules to prevent any debate over health care legislation (excessive debate is often seen as a stalling tactic by the minority) once it is drafted by their majority (closed). This is supposedly in an effort to hastily pass legislation as it is said to be TOO IMPORTANT to delay. Strict up or down vote allowing only amendments.

    The Geithner Plan (little specifics released) amounts to banks putting up 2.5%, Treasury 7.5% and the fed putting up 90% of original purchase price (OPP) for assets valued at an estimated 1.5% of OPP. Further, the banks will be refunded the first 2.5% should the assets exceed their contribution. In other words, gov takes the hit 1st.

  16. The extra cost of the Iraq war combined with the WOT is as of this year 878 Billion. Far from 100 B/month.

    The total national debt is 11200 B + 39000 B (that is indeed 39 T) more owed to Social Security.

    An additional 3900 B will be added for Obama’s deficit this year + he is borrowing an additional 760 B from SS surplus this year.

    1500 B of Obama’s debt this year is for the purchase of worthless assets and corp takeovers. The remaining 2400 B are the result of spending increases.

    We dont have money for this. A $Trillion is a BS estimates. The bill will cost us our future. We already have a 75 Trillion dollar debt(Fed, State, Personal) as a country. Not only would spending money we don’t have bankrupt us, this bill would still leave 37 million uninsured(The poorest 37mil.), it would within a very short time give the federal gfovernment absolute control over our physical bodies…The Central Government will own our health care, and our very bodies.

    I jumped for joy at news of the crash air france flight 447. I love watching the plane sink to its watery grave. I enjoy hearing the passengers screaming for help. The sound of drowning passengers gasping for air is music to my ear. The bottom of atlantic ocean is an awesome place to sleep on. The moment the jet broke up in midair must have been a kodak moment. I’m disappointed that the death toll is so low. A bunch of bodies floating on the atlantic ocean would’ve been an awesome sight.

  20. Total private debt is estimated to currently be at 16000 B and rising rapidly.

    It is not entirely clear whether policy will shift next year on how to fund these expenditures. Conflicting statements have been put out. Domestically we are lead to believe these debts will be monetized. This in effect will shift the impact by 3-5 years and will result in MAJOR inflation and unemployment later.
    China and other nations have been told that the funds will come from increased taxation.

I suugest you re-read my previous comment and tell me how you intend to pay the $250, 000 you owe on the deficit right now. I assure you The Obama Administration and the Democrat Congress are already trying to figure out how to extract it from you. Obama attacked McCain saying he would “Tax health benefits”…Now, Obama proposes taxing health benefits.

    I don’t think there will be a hasty decision made here, it’s going to take a lot of time and money. The GOP should work together with the democrats a bit more and not propose their own health care reform bill.

    This does not include the 750 B in emergency loans extended to the banks late last year as these will likely be paid back.

    Obama has further proposed expenditures for the next 8 years that total 15000 B (15 Trillion) according to CBO numbers based on current production. Obama admin claims they will only amount to 12000 B but is reliant on not just sustained production but an increase in production (highly likely production will fall so both may be low).

    These number assume an average SS

    What do you mean “initial phase of debate”? The “stimulus” bill was voted on with less than 2hours of debate. No one read that 1000 page bill. You want to know how much this will cost You? Before uncle Obama takes over control of your physical body, your share of the burden… what you Already owe because he doubled the debt, is $250,000per person Thats your share of the debt if this Doesnt pass. x 2 If it does. Do you have any idea what the interest alone on SSI is? Comparitively, War is Cheap!
